On Behalf of | Jul 24, 2019 | Domestic Violence |

The time surrounding a domestic violence arrest is scary, confusing and difficult for everyone. Regardless of which side you are on, you may wonder what happens after the arrest in California. If you are the one arrested, it can be a very intimidating thing to not know what will happen to you. If you are the victim, you may be afraid of what may happen next. It can help to learn the basic process so you know what to expect.

Domesticshelters.org explains that after an arrest for domestic violence, you will go to the police station where an officer will book you in. This involves getting your mugshot and fingerprints taken. You may be given a chance to make a phone call, and an officer may interview you to get your side of the story.

You will likely be put in a holding cell where you will wait until officers either take you to the general population area of the jail or you go before a judge. It depends on the day of the week and time of day as to whether a judge is available to hear your charges. In court, you will hear the charges against you and get bail set. The judge will also outline the conditions of your bail, which will likely include no contact with the victim. You will also get your next court date.

If you can pay your bail, you will be released upon payment. If you cannot pay bail, then you will go into the general population at the jail and stay there until your next court hearing. This information is for education and is not legal advice.
