Lamar Odom evades Khloe Kardashian to delay divorce

Even the best relationships do not always run smoothly. Disagreements are bound to arise from time to time, some more serious than others. One thing is certain, though — avoiding the problem, or ignoring it completely, will not make it disappear. A high-profile California divorce case highlights the futility of trying to halt divorce proceedings by using evasive tactics.

It has been almost a year since Khloe Kardashian initiated divorce proceedings from her husband, former NBA player Lamar Odom. It has been reported that he has been uncooperative and has refused to sign the necessary papers. In what appears to be an attempt to obstruct things further, Mr. Odom is now being very elusive, proving difficult to locate and having no contact with Ms. Kardashian for several weeks.

Due to the length of time that has passed since Ms. Kardashian last heard from her estranged husband, she has two legal options available to her. She can pursue a Request To Enter A Default, as more than 30 days have elapsed since Mr. Odom last responded to her. Alternatively, she could choose to issue a Request For Dismissal, which would cancel the divorce proceedings completely. Reports would appear to indicate that Ms. Kardashian is not interested in a reconciliation and simply wishes to move forward with her life.

This dilatory tactic may be able to create a delay, but it will not ultimately prevent the progression of a divorce. Under California laws, where there are no children within the marriage and no community property, it is not necessary for the other party to cooperate. Absenting oneself from the situation will not achieve the goal intended and does not reflect favorably upon the spouse who employs this stratagem. One who encounters such problems would be best served by seeking appropriate advice and guidance relative to the circumstances of his or her personal situation.
