Deciding on which parent gets primary child custody of the children during divorce negotiations is hardly ever an easy factor to determine. In fact, custody battles can go on between the separated spouses until the children turn 18 in California as well as in the rest of the country. Hearings to determine a change in the existing custody situation can be brought on by a number of factors. For example, one parent may choose to request primary child custody after a significant and dangerous event occurs with one of the children.
The talented singer Usher’s ex-wife Tameka Foster requested that she regain primary custody after one of their two children was involved in an accident. The boy, age five, got his arm caught in a pool drain while under the supervision of his aunt. The boy was saved and taken to a hospital, and he will be released soon.
Originally, Foster had custody of the children after divorcing from a marriage which lasted from 2007 to 2009. However, last year, Usher won primary custody. The judge denied Foster’s request to have temporary primary custody since this was one single accident, which was not enough to relinquish primary custody in the judge’s opinion.
Child custody negotiations are an ongoing and complicated matter. It is sad when negotiations turn nasty, such as Usher and Foster’s, but unfortunately this is the case for many separated spouses. Separating couples could use the help of California professionals in divorce and child custody law to help them make more peaceful negotiations and decide on what is best for the children.
